1. Agreement to These Terms

These Terms of Service (Terms) govern your access to and use of Best Testimonial Software, including our website, dashboard, APIs, and related services (Service). By creating an account, connecting third-party providers, or using the Service, you agree to these Terms.

If you are using the Service on behalf of a company or organization, you represent that you are authorized to bind that entity to these Terms.

2. Eligibility and Accounts

You must provide accurate registration information and keep your credentials secure. You are responsible for activity under your account and workspace, including actions taken by invited team members.

You must promptly notify us of unauthorized account access, credential compromise, or suspected misuse.

3. Service Scope and Changes

We provide tools to collect, import, moderate, and publish testimonials and customer proof content. Features may be updated, modified, or removed to improve reliability, security, legal compliance, or product quality.

Some features may be labeled beta or testing mode and are provided on a best-effort basis. We may impose limits or safeguards to prevent abuse and protect platform stability.

4. Customer Content and Rights

You retain ownership of content you submit or import, including testimonials, names, ratings, text, images, and metadata (Customer Content). You grant us a worldwide, non-exclusive, royalty-free license to host, process, copy, transmit, and display Customer Content solely to operate, secure, and improve the Service.

You represent that you have all necessary rights and permissions to collect, import, and publish Customer Content, and that your use complies with applicable laws, platform policies, and third-party terms.

5. Third-Party Integrations

The Service may integrate with third-party providers such as Google APIs. Your use of those integrations is also subject to the provider terms and policies. We are not responsible for third-party systems, availability, pricing, or policy changes.

You can disconnect integrations from your workspace settings where supported. Certain imported data may remain in your account until deleted by you or removed under your retention settings.

6. Acceptable Use

You agree not to:

  • Use the Service for unlawful, fraudulent, deceptive, or abusive activity.
  • Attempt unauthorized access to accounts, systems, or data.
  • Upload malware, harmful code, or content that disrupts the Service.
  • Infringe intellectual property, privacy, publicity, or consumer protection rights.
  • Misrepresent testimonial authenticity or create fake reviews.
  • Bypass rate limits or technical safeguards.

7. Fees, Billing, and Taxes

Paid plans, usage limits, and billing terms are described in-app or on pricing pages. Unless stated otherwise, fees are non-refundable except where required by law. You are responsible for applicable taxes, duties, and similar governmental charges.

We may change pricing for future billing periods with reasonable advance notice.

8. Confidentiality and Security

We implement reasonable technical and organizational measures to protect data. However, no system can guarantee absolute security. You are responsible for securing your credentials and workspace-level access controls.

9. Suspension and Termination

We may suspend or terminate access if we reasonably believe there is a security risk, legal violation, non-payment, abuse, or breach of these Terms. You may stop using the Service at any time and request account deletion.

10. Disclaimers

The Service is provided on an as-is and as-available basis. To the maximum extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, Best Testimonial Software and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, or goodwill.

Our total aggregate liability arising out of or related to the Service will not exceed the amounts paid by you to us for the Service during the twelve (12) months before the event giving rise to liability.

12. Indemnification

You agree to defend, indemnify, and hold harmless Best Testimonial Software from and against claims, losses, liabilities, damages, and expenses (including reasonable legal fees) arising from your use of the Service, your Customer Content, or your breach of these Terms.

13. Governing Law

These Terms are governed by the laws applicable in your principal contracting jurisdiction with us, without regard to conflict-of-law principles. Venue and dispute resolution will be determined by applicable law and any written contract terms between you and us.

14. Changes to These Terms

We may update these Terms to reflect product, legal, or operational changes. The Last updated date will be revised accordingly. Continued use after changes become effective constitutes acceptance of the updated Terms.
